  • Reckless conduct proscribed in a firearm statute can be less culpable than the conduct necessary for involuntary manslaughter. However, it must be more than that necessary for ordinary negligence. Inadvertent acts of negligence without recklessness, while giving rise to civil liability, will not suffice to impose criminal liability. The culpable conduct necessary for reckless conduct falls between the criminal negligence necessary for involuntary manslaughter and ordinary negligence. As with willful conduct, reckless conduct requires an awareness that serious injury will likely result.

Holdings:

The Virginia Court made the following holding:
  • Va. Code § 46.2-859. Passing a stopped school bus; prima facie evidence.  A person driving a motor vehicle shall stop such vehicle when approaching, from any direction, any school bus which is stopped on any highway, private road or school driveway for the purpose of taking on or discharging children, the elderly, or mentally or physically handicapped persons, and shall remain stopped until all the persons are clear of the highway, private road or school driveway and the bus is put in motion; any person violating the foregoing is guilty of reckless driving. The driver of a vehicle, however, need not stop when approaching a school bus if the school bus is stopped on the other roadway of a divided highway, on an access road, or on a driveway when the other roadway, access road, or driveway is separated from the roadway on which he is driving by a physical barrier or an unpaved area. The driver of a vehicle also need not stop when approaching a school bus which is loading or discharging passengers from or onto property immediately adjacent to a school if the driver is directed by a law-enforcement officer or other duly authorized uniformed school crossing guard to pass the school bus. This section shall apply to school buses which are equipped with warning devices prescribed in § 46.2-1090 and are painted yellow with the words “School Bus” in black letters at least eight inches high on the front and rear thereof. Only school buses which are painted yellow and equipped with the required lettering and warning devices shall be identified as school buses.

Facts:

Defendant appealed her conviction by the Circuit Court of Fairfax (Virginia) of reckless driving by speeding 70 miles per hour in a 45 miles-per-hour zone under Va. Code Ann. § 46.2-862, following the denial of her motion to strike the evidence obtained by pacing to prove her speed, alleging that pacing was not a method for determining speed listed in Va. Code Ann. § 46.2-882.

  • Nothing in Va. Code Ann. § 46.2-882 suggests it is meant to limit the means for proving speed. The statute itself states that speed “may” be determined by the enumerated means. “The word “may” is prima facie permissive, importing discretion, but the courts construe it to be mandatory when it is necessary to accomplish the manifest purpose of the Virginia legislature. Even lay witness testimony has always been an acceptable method of the speed of a car. The statute does not prevent the Commonwealth from proving a vehicle’s speed by other methods.

Millen v. Commonwealth

Facts:

Defendant was convicted of three counts of possession with the intent to distribute a Schedule II controlled substance and one count of possession with the intent to distribute a Schedule III controlled substance.  He challenged a judgment of the Circuit Court of Fairfax (Virginia), which denied his motions to suppress and to dismiss or consolidate the indictments for three counts of possession with the intent to distribute oxycodone.  The trial court found that, because the Endocet tablets and the oxycodone tablets had different composition of pharmaceuticals and were found in two different pockets of appellant’s pants, those two charges were distinguishable.  The trial court distinguished the liquid oxycodone based on the fact that it was found in a “separate location.

  • In enacting Va. Code Ann. § 18.2-248, the General Assembly declared it unlawful for any person to sell, or possess with intent to sell a controlled substance. Va. Code Ann. § 18.2-248(A). Va. Code Ann. § 18.2-248(C) prescribes the punishment for any person who violates Va. Code Ann. § 18.2-248 with respect to a controlled substance classified in Schedule I or II.  The gravamen of the offense is clearly possession of the specified drug with the requisite intent.  Thus, each distinguishable incident of the offending conduct constitutes a “unit of prosecution” for violation of the statute.

Facts:

Defendant was convicted in the Circuit Court of Fairfax (Virginia) of DUI in violation of Va. Code Ann. § 18.2-266. He had previously pled guilty to speeding in violation of Va. Code Ann. § 46.2-870.
