  • While parents or persons standing in loco parentis may administer such reasonable and timely punishment as may be necessary to correct faults in a growing child, the right cannot be used as a cloak for the exercise of uncontrolled passion, and such person may be criminally liable for assault and battery if he inflicts corporal punishment which exceeds the bounds of due moderation. Where a question is raised as to whether punishment has been moderate or excessive, the fact is one for the fact finder to determine from the attending circumstances, considering the age, size and conduct of the child, the nature of the misconduct, and the kind of marks or wounds inflicted on the body of the child.

Claret v. Commonwealth

Facts:

Defendant was arrested for prostitution after making a sexual offer to police officers in an unmarked vehicle.  The officers searched defendant and found cocaine.  Defendant was convicted of cocaine possession.  Defendant questioning that how the police officer searched the vehicle without warrant.  The appellate court upheld the conviction and dismissed the defendant’s arguments and ruling that defendant was lawfully searched the probable cause existed, to arrest her for solicitation, even if she committed no act of prostitution at the time.

  • Va. Code Ann. § 18.2-346 provides that any person who, for money or its equivalent, offers to commit adultery, fornication or any act in violation of Va. Code Ann. § 18.2-361 and thereafter does any substantial act in furtherance thereof, shall be guilty of being a prostitute, or prostitution. Evidence of “a substantial act performed in furtherance of the offer” is essential to the offense.
  • Whether a warrantless arrest is constitutionally valid depends upon whether, at the moment the arrest was made, the officers had probable cause to make it. If so, such arrest of a suspect is a reasonable intrusion under U.S. Const. amend. IV and that intrusion being lawful, a search incident to the arrest requires no additional justification. Conversely, however, a warrantless arrest that is not based upon probable cause is unconstitutional and evidence seized as a result of an unconstitutional arrest is inadmissible, without regard to the officer’s good faith and reasonable belief that he was not factually or legally mistaken.

Davis v. Commonwealth

Facts:

Defendant was charged with a felony involving the distribution of marijuana in Fairfax. After the jury found defendant guilty of the felony, the trial court set aside the felony verdict because the prosecutor had failed to prove the weight of the marijuana involved. On retrial for the lesser-included misdemeanor offense of distributing marijuana, the trial court denied defendant’s request to dismiss the charge on double jeopardy grounds. On appeal, defendant argued that double jeopardy applied and that the trial court erred when it refused to dismiss the charge. The court rejected defendant’s argument. The court found that defendant was not acquitted of the lesser-included misdemeanor for double jeopardy purposes by the trial court’s ruling. The court further noted that the jury’s verdict on the felony charge established that sufficient evidence had been presented at trial to sustain a verdict for the misdemeanor charge of distribution of marijuana. The court pointed out that had the trial court denied defendant’s motion to set aside the felony verdict, and defendant had appealed that decision to the court, the result would have been identical to the trial court’s disposition of this case.

  • The consistent practice in Virginia, when the evidence is found insufficient to sustain a felony conviction on appeal, but sufficient to sustain a conviction on a lesser-included misdemeanor offense, is to remand the case for retrial on the lesser-included offense. Jackson v. Commonwealth

Facts:

When defendant attempted to sell drugs to a minor, the police secured the permission of her parents to involve the minor in the investigation. Defendant was arrested and charged with distributing cocaine to a minor when he attempted to carry out a drug transaction with the minor.  Defendant appealed his conviction.  On appeal, the court affirmed the conviction that was entered by the trial court. The court held that, when the evidence was viewed in the light most favorable to the theory of entrapment, it was still clear that defendant initiated the drug transaction with the minor and that the police merely afforded an opportunity for him to commit the offense. The court further rejected defendant’s contention that the Commonwealth had to prove he knew the girl was a minor.

Code Ann. § 18.2-255, modifies the phrase, “distribute any drug..” The Commonwealth is required to prove that a defendant knowingly or intentionally distributed a controlled drug. McDowell v. Commonwealth

Facts:

Defendant challenged convictions from the Circuit Court for Fairfax (Virginia), which were for solicitation or encouragement of children under the age of 18 to appear in sexually explicit visual material in violation of Va. Code Ann. §§ 18.2-374.1(B)(1), 18.2-370(6).  A jury convicted defendant of soliciting children under the age of 18 with intent to induce or force each of them to be the subjects of sexually explicit visual material and for obscene communication through online and impose punishment for the same.  On appeal, the court reversed the convictions.  The appellate court held that what are all the photographs taken by the defendant were not sexually explicit visual material under Va. Code Ann. §§ 18.2-374.1(B)(1), 18.2-370(6).  Hence the evidence was insufficient to prove the photographs were sexually explicit visual material.

  • While the lapse of time between the alleged event of sexual abuse and the report is certainly an issue, it is a question of weight rather than of admissibility. The accompanying circumstances must determine how far the delay has been successfully explained away. Holder v. Commonwealth

Facts:

Officers were dispatched to defendant’s home in response to a complaint involving what turned out to be, after interviewing several people, misdemeanor family assault charges against defendant. An officer told defendant he was under arrest for the misdemeanor assaults. The officers then attempted to open the door to defendant’s home. Defendant resisted by trying to keep the door shut. In the process, defendant struck an officer, the door was opened, and defendant was arrested without a warrant for the misdemeanor assaults as well as the charges in this indictment, two counts of assault and battery of a law enforcement officer in violation of Va. Code Ann. § 18.2-57(c).  The defendant moved to suppress his arrest.  The issue was whether defendant was lawfully arrested, and, if not, whether his resistance to arrest was unreasonable.
