Claret v. Commonwealth

Facts:

Defendant was charged with possession of cocaine in Fairfax Virginia.  Defendant sought to suppress evidence obtained following her arrest for being drunk in public, Attorney defending that her arrest was unlawful and that any contraband discovered thereafter was inadmissible.  The court denied the motion to suppress. The court found the issue was whether the arrest for being drunk in public was valid under the circumstances. The court found that the trooper acted reasonably, and it was proper for him to charge defendant with being drunk in public. The arrest was not a pretext arrest.

Jackson v. Commonwealth

Facts:

Defendant made a motion to dismiss pending charges of possession of child pornography in violation of Va. Code Ann. § 18.2-374.1:1. Defendant also made a motion to suppress.  When the police performed a forensic analysis of defendant’s computer, which was seized when he was arrested, the investigator found images of child pornography and also cartoon pictures of child pornography that were contained in a “temporary internet cache.” Based on the investigation, it was determined that the operator of defendant’s computer visited websites that contained images of child pornography, viewed those images, but took no further action. Therefore, defendant argued that such actions did not constitute “possession” of child pornography.  Upon consideration, the court denied the motion to dismiss.

To do so turns abysmal ignorance into knowledge and a less than valetudinarian grasp into dominion and control.

James v. Commonwealth

Facts:

Following a bench trial, defendant was convicted of four counts of possession of child pornography in violation of Va. Code Ann. § 18.2-374.1:1.  Defendant contended that because he had previously abandoned the computer, he was not in possession of the computer or its contents on the date alleged in the indictment.  The appellate court concluded that defendant, as a prior tenant, did not have sufficient dominion and control over the computer on the alleged date to permit the conclusion that he possessed the images contained thereon on that date.  Accordingly the Circuit Court of Fairfax (Virginia) sentenced him for possession of illegal images in his computer.

  • In order to convict a person of illegal possession of contraband, proof of actual possession is not required; proof of constructive possession will suffice. To support a conviction based upon constructive possession, the Commonwealth must point to evidence of acts, statements, or conduct of the accused or other facts or circumstances which tend to show that the defendant was aware of both the presence and character of the contraband, and that it was subject to his dominion and control. Ownership or occupancy of the premises on which the contraband was found is a circumstance probative of possession. However, the Commonwealth is not required to prove that there is no possibility that someone else may have planted, discarded, abandoned or placed the contraband where the contraband is discovered. To resolve the issue, the court must consider the totality of the circumstances established by the evidence.

  • Grand larceny consists of the theft, not from the person of another, of goods and chattels valued at $200.00 or more. Va. Code Ann. § 18.2-95(ii). In a prosecution for larceny, proof that an article has some value is sufficient to warrant a conviction of petit larceny, but where the value of the thing stolen determines the grade of the offense, the value must be alleged and the Commonwealth must prove the value to be the statutory amount. Thus, as grand larceny requires the theft of goods and chattels valued at $200 or more, the burden was on the Commonwealth at trial to prove that the items Watson stole met or exceeded that amount.
  • When a statute prescribes a maximum imprisonment penalty and the sentence does not exceed that maximum, the sentence will not be overturned as being an abuse of discretion. Likewise, a revocation of a suspended sentence lies in the discretion of the trial court and this discretion is quite broad.

Millar v. Commonwealth

Facts:

Defendant was charged with feloniously distributing a Schedule II controlled substance, cocaine, on three separate occasions.  Accordingly, three petitions alleging that he committed delinquent acts were issued. Because defendant was subject to life in prison, if convicted of two or more offenses, the Commonwealth’s Attorney filed a notice in the juvenile and domestic relations district court for Fairfax, requesting a transfer of the case to the circuit court for trial as an adult.

Moors v. Commonwealth

Facts:

Defendant sought review of a judgment from the Circuit Court for Fairfax (Virginia), which convicted defendant of burglary with intent to commit a felony and of assault and battery.  In finding the evidence sufficient to prove that defendant committed the crimes, the court held that the jury was entitled to reject the alibi testimony because determining the credibility of witnesses who gave conflicting accounts was within the jury’s exclusive province.  The court also held that defendant was not entitled to an instruction on breaking and entering with the intent to commit a misdemeanor even though defendant was convicted of misdemeanor assault and battery. In so holding, the court noted that defendant entered the apartment with the intent to commit rape, a felony, rather than with the intent to commit a misdemeanor assault and battery.
